the3million on starting legal proceedings against the Government for denying the vote of thousands of EU citizens in the 2019 European Elections.
Many thousands of EU citizens across the UK were denied their vote in the European Elections in May 2019. There is clear Government responsibility, yet it will not hold a public inquiry despite several successful petitions that between them gathered over 150,000 signatures.
A great number of you supported our CrowdJustice appeal which enabled us to research and analyse well over 1,000 individual cases of citizens on both sides of the Channel who were denied their vote in the May European Elections. We used our findings to get advice from our expert public law practitioners.
Following this advice, British in Europe will not pursue further action at this stage.
the3million will, however, go ahead to start legal proceedings against the Government with the next phase which is to send a Letter Before Claim to the Government. We will be doing this within the next few days, and need to identify a small number of individuals who are willing to be named as co-claimants with the3million. In order to do so, we have launched a new research form to gather more precise details of how EU citizens were disenfranchised in the UK. Even if you filled in our earlier form, please take the time to fill in this new form, and share it with any other EU citizens you know who were denied their vote. Once we know who our co-claimants will be, we will post an update to introduce them to you.
After the Letter Before Claim, the next stage would be actually issuing the claim with the High Court after which we must wait for a decision from the courts to grant permission to proceed and on whether it will cap the costs of the case. In the meantime, legal costs from both our lawyers and the government will be incurred, so in order to guarantee the protection of the individuals and the3million involved in the case, we need to raise more money now – around £65,000 to £80,000. We will not go ahead with issuing the claim unless we have raised this money, as we cannot possibly put anyone or our own organisation at risk.

We need to fundraise another £65,000 in order to issue the claim and seek permission from the High Court to proceed to a full hearing. This amount covers all our legal costs by the team who worked with Gina Miller in 2017.
